Citizens file suit asking for injunction to stop proposed commercial poultry farm

The fight over the proposed 60-house commercial poultry operation on Highway 441 South in Coffee County has been destined to end up in a courtroom battle since the project began.


It’s finally happened.

On Friday, July 18, 2025, a group of local citizens filed suit in Superior Court against several defendants seeking “an injunction to prevent the continued construction and operation of the Defendants’ commercial chicken operation.”


The plaintiffs are listed as Bruce Brooker, Rebecca Temple, LeGrand Roberts, Hamp Adams, and Sims Funeral Homes, Inc., all of whom own property adjoining to or nearby the poultry farm. The defendants are Patrick Robinson, Daniel Farm LLC, Chelsea Farm LLC, Thuyvy Farm LLC, Hoang Family Farm LLC, S&P GA Farms LLC, HPS Holdings LLC, David Varnedore Jr., John Does No. 1-5. The John Does No. 1-5 are “unidentified individuals or entities involved in the development of the commercial chicken house operation that is the subject of this action.”

According to the suit, Daniel Farm owns Tract 1, approximately 197.4 acres, and will include 12 chicken houses. Chelsea Farm owns Tract 2, 125.93 acres, and will include 12 chicken houses. Thuyvy Farms owns Tract 3, 182.5 acres, and will include 12 chicken houses. Hoang Farms owns Tract 4, 133.86 acres, and will include 12 chicken houses. S&P GA Farms owns Tract 5, 95.28 acres, and will include six chicken houses. Varnedore still owns Tract 6, 78.67 acres, and will include six chicken houses. HPS Holdings owns Tract 7, 173.54 acres.

The filing also states that this operation will be the largest chicken farm east of the Mississippi River and will contain up to three million chickens at a time, “many of which will be located within the 50- and 100-year floodplains of the Satilla River.”

Given the number of chickens that the farm could house, the filing states that a poultry farm of this size could produce as much phosphorous as a city of 400,000 people.

The suit also addresses other environmental concerns, negative health effects, the possibility of bird flu outbreaks, and diminished property values, among other potential issues.

The plaintiffs are being represented by the law firm of Evans Bowers of Atlanta and Stack & Associates, PC, also of Atlanta.
