The plaintiffs who have filed suit seeking an injunction against the proposed 60-house commercial poultry farm in southern Coffee County have notched an early victory. It’s a small victory but it’s a victory nonetheless.
Thursday, Judge Kelly Brooks, the presiding judge in the case, issued a 30-day injunction ceasing all physical development of the property. Judge Brooks also issued a second order establishing a date for a hearing on the matter.
Currently, there is some ongoing site development at the location but actual construction of the houses has not begun. The order states that the plaintiffs sufficiently articulated that the farm could irreparably damage their property. The order adds that “If a Temporary Restraining Order is not issued, immediate and irreparable injury, loss, or damage will result to Plaintiffs prior to such hearing.”
According to the order, the defendants “may continue all development activities, including but not limited to, planning, permitting, engineering, and all other development activities that do not include physical development activities on the 1,000-acre site.” The injunction will remain in effect for 30 days or until the Court issues another ruling.
Judge Brooks also set a date for a hearing “on all issues relevant to the issuance of an interlocutory injunction.” The hearing will take place at 9 a.m. on August 12, 2025, in the courtroom located at the Law Enforcement Center on Thompson Drive in Douglas.
